Cuyahoga County Domestic Relations Court is located in the Old Cuyahoga County Courthouse on One West Lakeside Avenue, Cleveland, Ohio 44113. Ohio Family Relations Courts are responsible for proceedings arising from such divorce, dissolution of marriage, annulment, separation from you, spousal splitting, custody of children and parental rights (retention). Technically, all divorces lead to dissolution – a formal judicial decree that dissolves the bonds of marriage. In practice, dissolution is a reciprocal agreement to divorce with the minimum participation of the court – no referrals, discoveries, motions, hearings or trials. A: You and your spouse must negotiate and agree on the terms of the division of assets and debt, any applicable sped support, child support and the rights and obligations of the parents. They will detail these conditions in a separation agreement. One of you must have lived in Ohio for at least six months before following your resolution. You and your spouse will file an application for joint dissolution and ask the regional court to approve your joint separation contract and terminate your marriage. You will attend a court hearing to testify before the judge that you wish to dissolve your marriage and that you have voluntarily entered into your agreement.
Dissolution is sometimes known as „no guilt“ divorce. Dissolutions can be used if the parties believe that they can enter into the legal process amicably, without major disagreement on issues such as the distribution of assets or the division of parental rights and obligations. This cost-saving approach is a realistic alternative for many separating couples, especially as the parties and their lawyers must agree on all facets of the separation of parties before entering a courtroom. The court requires that all issues be resolved, including assets, debts, custody agreements, child care and spos assistance. The terms of the separation agreement must also be fair and proportionate, in accordance with Ohio`s status.
